General Rental Terms and Conditions

These General Terms and Conditions apply to vehicle rentals by Luxury Sport Cars Vienna GmbH. The booking confirmation, agreed tariff and handover record form part of the rental contract.

1. Scope

These terms apply to all quotations, bookings and rentals unless an individual written agreement states otherwise. Conflicting customer terms are excluded. Mandatory consumer rights remain unaffected.

2. Contract formation

Website displays and quotations are invitations to book. A contract is formed when we issue a booking confirmation or hand over the vehicle. A vehicle model is guaranteed only where expressly confirmed; otherwise an equivalent vehicle may be supplied.

3. Rental period, handover and return

The agreed period, location, included kilometres and return time appear in the booking confirmation. The renter must inspect the vehicle, ensure existing damage is recorded and return it with all documents, keys and accessories in the agreed condition and fuel or charge level.

  • Extensions require our prior approval and may be charged at the current rate
  • Late return may trigger additional rental days, availability losses and recovery costs
  • The rental ends only when the vehicle is returned to and accepted by us at the agreed location

4. Driver requirements

Only drivers named in the contract may drive. Each driver must present a valid original licence, identity document and any required international driving permit, and satisfy the category conditions notified at booking.

The booking-specific condition prevails. We may refuse handover where documents, ability to drive, payment security or eligibility are insufficient.

5. Rental charges

The renter owes the agreed rental price plus applicable extras, excess kilometres, fuel or charging, cleaning beyond ordinary use, damage, tolls, fines administration, collection and other contractually disclosed charges. Prices include VAT unless stated otherwise.

6. Payment and security deposit

We may use the deposit for contractual claims and request additional security where risk materially changes, subject to mandatory law.

7. Use of the vehicle

The vehicle must be used carefully, lawfully and according to manufacturer instructions. The renter must secure it, use the correct fuel or charging equipment and monitor warning indicators.

  • No racing, speed testing, driver training, track use or timed events
  • No sub-rental, unauthorised drivers, towing or carriage for reward
  • No driving under alcohol, drugs, impairing medication or fatigue
  • No smoking, unlawful goods, overloading, off-road use or deliberate deactivation of safety or telematics systems
  • Animals only with prior permission and suitable protection

8. Cross-border travel

Leaving Austria requires our prior written approval and is limited to approved countries. The renter must obtain and pay for required vignettes, tolls and environmental permits. Unapproved travel may invalidate cover and makes the renter liable for resulting loss, recovery and repatriation costs.

9. Insurance and excess

Any limitation of liability applies only if all contractual and reporting duties are met. The renter remains liable without limit where required by law, especially for intentional damage; consequences of gross negligence are assessed under applicable law and insurance terms.

10. Accident, damage and breakdown

After any accident, theft, fire, wildlife collision or material damage, secure the scene, assist persons, contact police where required or another party is involved, and notify us immediately at +381614114244. Do not admit liability.

  • Record parties, witnesses, vehicles, insurers, location and photographs
  • Submit the complete accident report and keys without delay
  • Use only assistance or repairs approved by us unless emergency action is essential
  • Failure to cooperate may create liability to the extent it causes loss or prejudices insurance cover

11. Traffic offences, tolls and parking

The renter bears all fines, tolls, parking charges and related costs arising during the rental. We may provide driver data to competent bodies and charge a reasonable disclosed administration fee for processing enquiries, without affecting the authority's claim.

12. Lessor liability

We are liable without limitation for intent, gross negligence, personal injury and mandatory statutory liability. For slight negligence, liability is limited, where legally permitted, to breach of essential contractual duties and foreseeable typical loss. We are not liable for items left in the vehicle or indirect loss outside mandatory law.

13. Termination

Either party may terminate for serious cause. We may terminate and recover the vehicle where payment security fails, information is materially false, use is dangerous or prohibited, or a material duty is breached. The renter must return the vehicle immediately and bears justified recovery costs.

14. Data protection

Personal data is processed to administer the rental, payment, security, claims and legal duties as described in our Privacy Policy. Connected vehicles may transmit telematics data for the limited purposes stated there.

15. Complaints

Please send complaints promptly to info@example.com, stating the booking number and relevant evidence. We aim to acknowledge and assess complaints without undue delay. Consumers may also use competent statutory conciliation bodies.

16. Final provisions

Austrian law applies, excluding conflict-of-law rules and the CISG, without depriving consumers of mandatory protection in their country of habitual residence. Statutory consumer venues remain unaffected; otherwise the competent court at Commercial Court of Vienna is agreed where legally permitted.

Changes and side agreements should be recorded in text form. If a provision is invalid, the remaining provisions continue to apply; mandatory law replaces the invalid provision.
